Personal injury compensation claim advice following a car accident
Personal injury compensation claim advice is available to all CoverGirl Car Insurance Services policies through our legal expenses insurance.
If you are injured in a car accident and need to make a personal injury compensation claim, this is what you can expect from your legal expenses insurance:
- Once you have informed us of your accident, our solicitors will begin to set out your
case for your personal injury compensation claim against the other person, based
upon the information you provide us
- A ‘Letter of Claim’ will be sent to the other person’s car insurance company, giving
notice that you intend to pursue a claim against them for injury and/or uninsured
losses caused in a car accident due to their client’s negligence
- The information needed to support your claim will be brought together. This may
include witness statements, police reports, vehicle engineer’s reports and other
information relevant to the car accident, which will later be used as evidence to
support your claim
- Our solicitor will ask you to complete a Claim Questionnaire, covering every aspect
of your compensation claim, to ensure you are compensated fully for everything you
are entitled to
- Our solicitor will arrange for you to see an independent medical expert. They will
prepare a report into the extent of your injuries and your recovery and any on-going
or long-term symptoms. The purpose of this report is to provide independent
evidence to support your claim and help our solicitors put a realistic figure on the
amount of compensation to be claimed
- A ‘Schedule of Losses’ will be drawn up which details all the financial losses
(heads of claim) that you are claiming for. This will be sent to the other person’s
insurance company, with a request for the claim to be settled
The ‘Schedule of Losses’ may include:
- Pain, suffering and loss of amenity
- Loss of earnings
- Damage to personal effects
- Cost of medication and prescriptions
- Other expenses

*A replacement car can normally be arranged under one of the following conditions: (1) Comprehensive policyholders – a replacement car may be available under the terms of your insurance policy. Please check your policy details for more information. (2) Non fault accident – where we have the name, car registration number and insurance details of the person who caused the accident, we can supply a replacement car. This is done on a credit hire basis which means the costs for this service will be passed onto the insurance company of the person who caused the accident. We may not be able to arrange a replacement car where we are unable to get an admission of liability from their insurance company, or where the driver is untraceable or uninsured. (3) Repair garage – if your car is booked in for repairs following an accident, the repair garage may be able to provide a replacement car (subject to availability).
