A recent ruling from the European Court of Justice means that for one Irish woman, car insurance compensation that has been denied her for the past 10 years will finally be awarded.
The woman's fight for justice began with an accident involving the commercial van she was travelling in. She was injured in the crash, and as the van's driver did not have valid motor insurance she turned to the Motor Insurers' Bureau of Ireland (MIBI) for compensation.
However, MIBI denied her request as Irish driving legislation does not cover "injuries to persons travelling in a part of a motor vehicle which has not been designed and constructed with seating accommodation for passengers". Unfortunately, the woman had been travelling in the load space in the back of the van at the time of the crash.
Not to be put off by this setback, however, the woman next appealed to the EU. She argued that the European 'Third Motor Insurance Directive' (which specifies that all passengers must be covered by some form of motor insurance) should guarantee her compensation regardless of Irish law - a view which was upheld by EU courts.
"This ruling is great news for the lady who fought so hard to get compensation, and for all victims of uninsured driving," said Gemma Turner, spokesperson for the woman car insurance experts at CoverGirl.
